Please read these 'Site User Terms' carefully before using our website.
Customers who use this webshop and make purchases are deemed to agree to the following conditions:
The web pages on our site and all related pages ('the Site') belong to and are managed by the company EZ Handel, located at Smyrnastraat 2A, 7413BB Deventer, The Netherlands. You ('the User') agree to be bound by the following terms and conditions by using any services offered on the Site and that by continuing to use the Services you confirm that you have the right, authority and legal capacity to enter into this Agreement, that you are 18 years of age or older, and that you have read, understood and agree to be bound by this Agreement.
This Agreement grants the parties rights and obligations with respect to the Site, and the parties agree by accepting this Agreement that they will perform said rights and obligations fully, accurately, timely and within the terms of this Agreement.
1. RESPONSIBILITIES
a. The Company reserves the right to make changes to the prices and products and services offered at any time.
b. The company undertakes to provide the user with access to the agreed services, unless there are technical failures.
c. The user agrees to refrain from reverse engineering the site, or attempting to discover the source code or taking other actions to obtain it. Users who violate this rule will be liable for damages caused to third parties, and legal action will be taken against them.
d. The user agrees not to create or share content that is contrary to public order, legislation, the rights of third parties or that is offensive, misleading, obscene or pornographic in nature, or that violates the rights of others. Should such a violation occur, the user will be fully liable, and the site reserves the right to suspend, terminate and take legal action against the accounts involved. In the event of requests from judicial authorities for information regarding users or accounts, the site reserves the right to share this information.
e. Relationships between users of the site or between users and third parties are the responsibility of the users themselves.
2. Intellectual Property Rights
2.1. All intellectual property rights on this site, including titles, company names, trademarks, patents, logos, designs, information and methods, whether registered or not, are the property of the company or the rights holder and are protected by national and international laws. Visiting the site or using the services does not grant any rights in relation to these intellectual property rights.
2.2. The information on the site may not be reproduced, published, copied, presented or transferred in any way. It is prohibited to use the whole or part of the site on another website without permission.
3. Confidential Information
3.1. The Company will not disclose the personal information of users, as provided through the Site, to third parties. This personal information includes, but is not limited to, the name, address, telephone number and e-mail address of the user, and is collectively referred to as "Confidential Information".
3.2. The User agrees that the Company may share the User's contact information, portfolio information and demographic data with its subsidiaries or affiliated companies for promotional purposes, such as marketing, advertising, campaigns and announcements. This data may be used to create customer profiles and conduct targeted promotions and statistical studies.
3.3. Confidential information may only be provided to government agencies if required by law or regulation or if such disclosure is requested by the competent authorities.
4. No Warranty:
THIS AGREEMENT SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. THE SERVICES PROVIDED BY COMPANY ARE PROVIDED "AS IS" AND "AS AVAILABLE." COMPANY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
5. Registration and Security
The user is obligated to provide accurate, complete and current registration information. Failure to do so will constitute a breach of this Agreement and may result in termination of the user's account without notice.
The user is responsible for the security of his passwords and accounts, both on this site and on third parties. The company is not liable for data loss or security breaches, or for damage to hardware and devices resulting from the user's negligence.
6. Force Majeure
In the event of events beyond the control of the parties, such as natural disasters, wars, riots, strikes, epidemics, infrastructure or internet failures and power outages (hereinafter collectively referred to as 'Force Majeure'), the parties shall not be liable for failure to fulfill their obligations. During this period, the rights and obligations of the parties shall be suspended.
7. Validity of the Agreement
If any provision of this Agreement is held invalid in whole or in part, the remainder of the Agreement shall remain in full force and effect.
8. Changes to the Agreement
The Company may change the Services and the terms of this Agreement in whole or in part at any time. Changes will become effective on the date of publication on the Site. It is the User's responsibility to keep up with changes. By continuing to use the Services, the User is deemed to have accepted these changes.
9. Notices
All notices relating to this Agreement shall be sent to the Company's email address and the email address provided by the User upon registration. The User agrees that the address provided is a valid address for notices, and that any changes must be communicated to the other party in writing within 5 days. Otherwise, notices sent to this address will be considered valid.
10. Dispute Resolution
The Dutch courts shall have jurisdiction over all disputes arising out of or in connection with the application or interpretation of this agreement.
